1) General

The products on the e-commerce site www.bottegaventuno.it are offered by Tramp di Giannone Pasquale hereinafter defined (Tramp) with VAT number 07222281219. The headquarters are in Naples in Vico San Domenico Maggiore, 21.
The e-mail address is ordini@bottegaventuno.it; the telephone number is +39 0810335542. Purchases made via the internet on the e-commerce site are governed by Italian law and by these contractual conditions indicated on the site at the time the order is placed (the "General Conditions"). Any dispute that may arise on the conclusion, interpretation, and execution of a sale stipulated through the Tramp e-commerce will be devolved to the exclusive jurisdiction of the Italian judicial authority.
 
2) Utenti ed Ordini
 
Only final consumers can use the Tramp e-commerce site, i.e. natural persons of legal age who act for purposes not related to any commercial, entrepreneurial, craft and/or professional activity carried out, and who fall within the definition of "consumers" contained in the Legislative Decree Legislative Decree 206/2005 and subsequent amendments (the "Consumer Code"). Tramp will consider valid and effective and will only take into consideration purchase orders that have the following characteristics:
- orders can only be processed if they concern a maximum of n. 10 items, and, in any case, for a maximum total value of €10,500.00;
- orders will be processed by Tramp only if the shipment is requested within the territory of the price list from which the order is placed.
All orders that do not have the above characteristics will not be accepted, and if accepted may be deemed invalid and ineffective by Tramp. In fact, Tramp reserves the right not to execute orders that do not have the characteristics indicated above.
 
It is also understood that Tramp may not process the order and/or deem it ineffective when it is not possible to verify the correctness of the information relating to the shipping address and billing data, or the same has been carried out for resale purposes , in which case Tramp reserves the right to terminate the contract with immediate effect and with simple written communication sent via email.
3) Prices
The purchase prices of Tramp products will be specific for each country from which the order, and will be inclusive (gross) of any taxes. Tramp may apply special promotions to one or more products on the site that change the price. The essential characteristics of the products and the prices are indicated in the product sheet on the site which the user must access before proceeding with the order. Product images may not fully correspond to the real ones.
4) Shipping
The transport costs of the product will be borne by the user of the e-commerce service which will be explicitly indicated during the purchase phase of the same. Tramp undertakes, as the user's representative, to stipulate a shipping contract with a leading company taking into account the conditions applied by the carrier itself.
 
User:
- may indicate that the purchase is sent to a different address than that of the 'holder of the order and/or billing (but always within the same country);
- must indicate a shipping address where someone is always present to pick up the parcel . In the event that someone is not present at the address indicated for the collection, a different address than the one of residence must be indicated where the requested condition is fulfilled;
- Tramp will normally process the order within 48 hours after receiving the confirmation of the payment. Estimated delivery times depend on the carrier chosen. Trampe is not responsible for the failed and/or delayed delivery of the parcel, if the collection methods described above are not respected, or if there are in any case incorrect indications from the customer;
 
- if the items ordered are not delivered within a period of 10 working days from the confirmation of the order, the user can contact Tramp's customer service directly. The order status and/or shipping status will be verified by the shipping company. The products will in any case be delivered in the shortest possible time and in any case within the terms of the law (i.e pursuant to article 61 of the Consumer Code 30 days from the Delivery Date). In certain circumstances, such as, by way of example, sales periods or plant closures, delivery times may vary. Tramp cannot be held responsible for delays in delivery not attributable to its fault or negligence. Therefore, Tramp shall be exempt from liability for delays due to force majeure, strikes, natural disasters, pandemics, facts relating to customs clearance procedures, and any other fact relating to the provision of courier services or any other circumstances beyond its control and / or unpredictable.
Without prejudice to the above, the user is requested to do everything possible to facilitate the delivery of the order, making yourself available for reception or delegating it to third parties. Upon delivery, the user must verify the accuracy of the number of packages and the integrity of the external packaging. In the event that the user finds anomalies in the delivery, for example with reference to the number of packages or in the presence of damage to the external packaging, he must sign the delivery document with reserve and contact Tramp's customer service. In the event that he fails to do so, the user will not subsequently be able to make any objection regarding the delivery, without prejudice to the provisions of the following art. 13 on the subject of hidden defects and in compliance with the law for the mandatory protection of consumers.
 
5) Compiling Orders
To conclude the purchase contract, the user must complete the order procedure present on the site in all its parts and confirm the payment of the order on the site of the selected payment institution. It is understood that orders from countries other than those indicated and with different characteristics than those provided above (in terms of quantity and place of shipment) will in no case be accepted.
6) Compiling procedures and information</ div>
Before proceeding with completing the order, the user must access the sections relating to existence of the right of withdrawal, and the methods and times for returning the product in the event of exercise of the same, as well as all other information relating to the General Conditions.
7) Order and Information
During the order procedure, a series of summary information on the characteristics of the product is provided , on the price, on the shipping costs, on the methods of delivery and payment of the product.
 
8) Filling orders and responsibilities
To complete the purchase contract, the order procedure and the payment on the site of the selected entity. Both operations must be performed following the instructions on the site. In the event that, due to a typing error or whatever, orders have been filled in which the user does not wish to carry out due to characteristics, quantities and/or prices, the user will not have to complete the procedure itself. The user is responsible for the correctness of the information provided during the order and payment procedure and Tramp assumes no responsibility for "unwanted" orders, sent by mistake and/or by minors, and will execute them in accordance with the information provided by the user and may demand payment of the agreed amount.
If during the order compilation and contract conclusion procedure, the user notes that the price of one or more of the products he intends to select for the subsequent purchase is clearly lower than the one normally applied, net of any discounts and/or promotions in force at that time, due to an evident technical problem which occurred on the site, please do not complete your purchase order and report the aforementioned technical error to Tramp by sending an email to the email address ordini@bottegaventuno.it
 
In cases where the user has completed his purchase order and the latter includes a product whose price is clearly lower than that normally applied, net of any discounts and/or promotions in force at that time, due to an obvious technical problem that occurred on the site:
(a) if the user himself has not yet received the product, Tramp will to (i) cancel the order, the delivery of which will therefore not be performed, by simultaneously sending a communication in this regard via e-mail, to the e-mail address indicated by the user during the compilation and transmission of the order and ( ii) reimburse the user for payments made in relation to the canceled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same means of payment used by the user for the initial transaction;
(b) if the user has received the product, Tramp will promptly inform via e - email the user of the error that occurred in the process of completing his order, offering the same, alternatively, to (i) pay to Tramp, within and no later than the following 5 (five) days, using one of the methods available payment terms, the amount corresponding to the difference between the correct price of the product and the incorrect price resulting from the purchase order, or (ii) cancel your order, following the instructions contained in the same communication and returning the product to Tramp, at the expense of the latter, within and no later than the following 14 (fourteen) days, by sending it to Tramp, free of damage, complete with all its elements and accessories (including the unaltered labels and tags attached to the product), accompanied from the attached instructions/notes/manuals, from the original packaging and packaging and from the guarantee certificate and accompanied by the return form, duly completed, which you will find attached to the e-mail sent by Tramp.
 
In the event that the user has chosen the option referred to in point (b) (ii) above, Tramp will reimburse the user for the payments made by the same in relation to the canceled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same means of payment used by the user for the initial transaction.
9) Order storage
The order confirmation and related data will be stored in Tramp's electronic database for the period necessary to process the order, and in any case for the period established by law. An order confirmation will be sent to the user via email with all the reference data of the order itself.
10) Conclusion of contract
The contract is finalized between the moment in which Tramp receives electronically the order confirmation and the moment in which Tramp receives the payment confirmation from the selected entity, after verifying the correctness of the data entered therein. Tramp has the right to refuse the order by notifying it by email within 2 days of receiving it, in the event of incorrect data or forwarding of an invalid and/or incorrect credit card code to the selected entity.
 
11) Unavailability of products
If the products presented on the Tramp e-commerce site are no longer available, it will be of Tramp communicate the possible unavailability of the products in the warehouse within 30 days of receiving the order. In the event that the price of the product has already been paid, Tramp will be responsible for returning the amount paid. In this hypothesis, nothing will be owed by Tramp by way of compensation for damages or any other title.
12) Legal guarantee
Without prejudice to the provisions of the previous art. 4, Tramp assumes responsibility for any lack of conformity of the products existing at the time of delivery of the products themselves and which occurs within two years of delivery.
Tramp guarantees the user that the products sold are not defective and that they comply with the provisions of the order and, therefore, in particular, that the products:
- comply with the description provided on the site and possess the qualities of the products that Tramp presented;
- are appropriate for the purpose for which goods of the same type are normally used;
- possess the quality and the usual performance of a good of the same type, which the user can reasonably expect, taking into account the nature of the good.
For technological reasons, Tramp cannot guarantee that the display of colors on the screen of the devices used to access your site will always be accurate, complete and updated. Marginal differences between the description of the product on the site and the actual characteristics of the product itself will not be considered as a cause of non-conformity of the product for the purposes of the order. The guarantee of conformity of the products sold on the site lasts for a period of 2 (two) years from the date of receipt of the products by the user. The rules set out in articles 129, 130 and 132 of the Consumer Code apply to the sale of Tramp products. In the event that a non-compliant Product is delivered, the user may request the restoration, free of charge, of the conformity of the products by repair or replacement. If this is not possible under the applicable law, you will be entitled to a corresponding reduction of the purchase price or a refund of the purchase price and (if applicable) the shipping costs.
The user will notify Tramp of any lack of conformity of the products within two years of delivery through the customer service. After receiving the aforementioned notification from the user, Tramp will contact the user to agree directly with the same the modalities of the withdrawal of the products. The mere receipt of the products by Tramp after the activation of the aforementioned procedure does not in any way imply the recognition by Tramp of a lack of conformity of the products, since an accurate verification by Tramp is necessary. The direct action to assert the hidden defects is prescribed, in any case, within the term of twenty-six months from the delivery of the product. Notwithstanding the foregoing, the warranty does not cover damage caused by mishandling of the products, misuse, accidents, water, solvents, wear, damage caused by carriers and, in any case, damage deriving from third party factors and not attributable to lack of conformity of the products.
13) Payments
Payment for online purchases made on the Tramp website can only be made by card Visa - American Express – Mastercard credit through the Paypal system.
 
The amount relating to the order will be charged to your credit card only at the time of shipment. The payment of orders takes place externally to the Tramp systems (within the Paypal servers), which therefore is in no way the owner or manager of the processing of bank details or data relating to the credit card with which the payment is made .
14) Withdrawal
The buyer has the right to withdraw from the contract stipulated with Tramp within 14 working days from the delivery of the products without any penalty and/or justification. To exercise the right of withdrawal, the buyer must send within 14 days from the date of receipt of the goods by registered letter with return receipt. a communication in which you expressly declare that you want to proceed with the return of what has been ordered. The communication may also be sent by fax and/or e-mail provided that it is confirmed by registered letter with return receipt. within the following 48 hours. The withdrawal can be exercised in case of purchase of a plurality of products even for only some of them. In the case of exercising the right of withdrawal, the user will have to return the goods sold to Tramp at his own expense, sending them to Tramp within 14 days from the date of exercising the right of withdrawal. Delivery should be made to Tramp's address for all goods. In order to be able to return the products, the purchased products must arrive at the address indicated above in perfect condition. The product must be returned with the original product packaging and with the product tag. To proceed with the return of the product, the steps indicated in the return procedure must be followed. If the withdrawal is not exercised in the manner indicated above, Tramp will not accept the returned products and will return the products to the user/customer without additional shipping costs.
 
14 bis) Exclusion of the right of withdrawal for personalized products
Pursuant to and by effect of article 59 c) of the Consumer Code, the right of withdrawal, cancellation or return is excluded in the case of orders relating to made-to-measure or clearly personalized products based on the choices made by the buyer.
15) Resi
The packaging of returned products (which is the buyer's responsibility) must be carried out with the original box in order to prevent the goods from arriving damaged at their destination. Only if the original packaging is unusable can an equivalent box in terms of size and strength be used. Return shipments made in ways other than those indicated above, which are the only ones authorized, will not be accepted. It is not possible to make returns of products following withdrawal with costs to be paid by the recipient. Once the return has arrived at its destination, Tramp will check the legitimacy of the return and, having verified the correctness of the operations, will send the user a confirmation email. The sums paid will be re-credited through the system with which the payment was made. The re-credit usually takes place within 14 days from the latest between the moment in which Tramp has been informed of the withdrawal and the moment in which Tramp has received the returned product from the buyer.
 
16 Disputes
Any sales contract concluded between Tramp and the buyer pursuant to these General Conditions will be governed and interpreted in accordance with Italian laws and in particular with the Consumer Code. In any case, the rights that may be attributed to the purchasers by mandatory provisions of law in force in the state of the latter will remain unaffected.
The buyer has the right to access the European Online Dispute Resolution platform (the European ODR) for the resolution of any dispute with Tramp. For more information on the European ODR Platform or to initiate, through the latter, an alternative resolution procedure for a dispute relating to the contract with Tramp, the buyer must access the following link: http://ec.europa.eu/odr .
